SMS/Text Messaging Program

Program Description: MAXimum Research operates text messaging programs to invite individuals to participate in market research surveys and political polling. Participants typically receive 1-2 messages per campaign.

 

Opt-In Process:

Contact information (including mobile phone numbers) is provided to us by our clients, who obtain it from official sources such as state voter registration databases. By providing your contact information to these official sources or directly to our clients, and through their engagement of our research services, you may receive text messages from MAXimum Research related to survey and polling invitations.

Message and Data Rates:

Message and data rates may apply. You will typically receive 1-2 messages per research campaign.

Mobile phone numbers used in our text messaging programs are:

• Provided to us by our clients, who obtain them from official voter registration sources

• Shared with our clients (the research sponsors) for survey administration and analysis

• Not sold or rented to third parties for marketing purposes

Our communications fall under established regulatory exemptions for non-commercial activities. The Federal Communications Commission has recognized that research calls, market surveys, and political polling are exempt from certain Telephone Consumer Protection Act (TCPA) restrictions because they serve informational purposes rather than commercial solicitation.

• FCC Rules: Political Campaign Calls and Texts - Political campaign communications have specific exemptions under FCC regulations

Consent and Data Source: Contact information used in our text messaging campaigns is provided to us by our clients. Our clients obtain this data from official government voter registration databases maintained by state boards of voters, state attorneys general, and other authorized state agencies. Our clients engage us to conduct political polling and market research on their behalf. The legal basis for these communications is:

1. Political communications are exempt from commercial telemarketing consent requirements under federal law

2. Market research and survey calls are classified by the FCC as non-commercial activities

3. Our role as a research vendor means we are acting on behalf of our clients, who have the direct relationship with voters through the civic and political process
